In New York, the rules related to adoption are outlined to all involved parties in advance.  The birth parents are provided with ample notice that someone is contemplating adopting the child, along with the details of the adoption. If a court has taken away the parental rights of birth parents and they wait too long to ask a higher court to change the ruling of the lower court, the birth parents cannot undo the adoption.  If the birth parents have an attorney, and/or come into court and agree to the adoption, the birth parents cannot later change their mind and undo the adoption. The courts look to the “best interests” of the child and seek to make a final determination based on all the evidence.
