An off-duty Buffalo Police Officer appeared in court on Wednesday after being involved in a crash that ended with a DWI charge.

David Rodriguez, 49, was caught drinking and driving in the Allen Street area last month when he crashed into the back of another vehicle. He refused all sobriety tests.

An Erie County judge found David Rodriguez guilty of a lesser DWI charge – driving while ability impaired. He was sentenced to a conditional discharge, which requires him to live a law abiding lifestyle for one year. Rodriguez also had his license suspended for 90 days.

The 23-year veteran of the Buffalo Police force is currently suspended with pay, pending an internal affairs investigation.
